آليات حماية المُستهلك من التَّعسف في عقد البيع بناء على التّصاميم

الملخص
اِهْتَدى المُشرع الجزائري إلى التّشريعات الخاصة بالموازاة مع الشّريعة العامة للعقد، منها تلك المتعلقة بضبط وتنظيم معاملات التّرقية العقارية، والتي يُعدُّ عقدُ البيع بناء على التّصاميم أبرزَ أصنافها، وأحد صور عقد بيع البناية في طور الإنجاز، إذْ رصد المشرع جملة من الآليات القانونية من أجل منع المرقي العقاري من فرض شروطه المجحفة للنّيل من المصالح الخاصّة للمُكتتب، وحتّى تبقي إرادة هذا الأخير سليمة وغير خاضعة لعوامل النفوذ الاقتصادي، والإستغلال من قبل المرقي العقاري، وكذلك تحقيق التوازن العقدي بين أداءات أطراف العقد، وتكريس العدالة العقدية، ولأجل ذلك أصبح من الأهمية بمكان على المشرع العمل على دمج عقود التّرقية العقارية لا سيما عقد البيع بناء على التّصاميم ضمن عقود الإستهلاك، وذلك بالتوافق مع المبادئ العامة للعقد، بالإضافة إلى أهمية فرض إجراءات ردعية مشدّدة على كل مرقي عقاري يستغل مركزه الاقتصادي القويّ لإستغلال الضعف الإقتصادي والمعرفي لمقتني السّكن. Abstract: The Algerian legislator was guided by special legislation in parallel with the general law of the contract, including those related to controlling and regulating real estate promotion transactions, of which the sale contract based on designs is the most prominent of its types, and one of the forms of the building sale contract is in the process of completion, as the legislator monitored a number of legal mechanisms in order to prevent The real estate promoter is able to impose his unfair conditions to undermine the private interests of the subscriber, and in order to keep the will of the latter intact and not subject to the factors of economic influence and exploitation by the real estate promoter, as well as achieving a contractual balance between the performances of the parties to the contract, and the consecration of contractual justice, and for this reason it has become very important to The legislator is working to integrate real estate promotion contracts, especially the sale contract based on designs, within the consumption contracts, in accordance with the general principles of the contract, in addition to the importance of imposing strict deterrent measures on every real estate upgrade that exploits its strong economic position to exploit the economic and cognitive weakness of housing owners.
