التجريم والعقاب كآلية قانونية لضبط قطاع المحروقات

الملخص
يعد قطاع المحروقات العصب الأساسي للإقتصاد الوطني ، لما يساهم به في إثراء الخزينة العمومية، حيث أنه ساهم بقيمة 35.4 مليار دولار ( إحصائية سنة 2022) مستفيدا من الحرب الروسية الإوكرانية، وهذا بعد توسيع شبكة الشراكة مع الكثير من الدول لا سيما الأوروبية. وهذا يعني الكثير من الأنشطة التي ستؤدي إلى إحداث أضرار وخيمة على البيئة، مما يجعل من تدخل المشرع أكثر من ضرورة وإلحاحا من أجل ضبط قطاع المحروقات،وذلك من خلال آلية التجريم والعقاب التي تعد من أنجع الوسائل في حماية البيئة من مخاطر الإستعمال العشوائي للطاقة. من خلال هذا المقال وقفنا على مدى مساهمة المشرع الجنائي في حماية البيئة من مخاطر استغلال المحروقات، وهذا من خلال سنه للعديد من النصوص القانونية المجرمة للكثير من الأفعال والسلوكيات الضارة بالبيئة، وهي في مجملها ما زالت بحاجة إلى مراجعة وتحيين مستمرين لمواكبة التطور الحاصل في مجال استغلال الطاقات الناظبة وغير المتجددة. Among the activities that will lead to severe damage to the environment, which makes the intervention of the legislator more than necessary and urgent in order to control the fuel sector, through,the mechanism of criminalization and punishment, which is one of the most effective means in protecting the environment from the dangers of indiscriminate use of energy.Through this article, we examined the extent to which the criminal legislator contributed to protecting the environment from the dangers - the risks - of exploiting hydrocarbons, and this is through his enactment of many legal texts that criminalize many actions and behaviors harmful to the environment, which in their entirety still need to be reviewed and updated continuously to keep pace with the development taking place in the field of enduring and non-renewable energies..
