استراتيجية الولايات المتحدة الامريكية لتحصين رعاياها أمام المحكمة الجنائية الدولية-us Strategy To Immunize Its Citizens Before The International Criminal Court -afghanistan Case

Abstract
The United States of America pursues to establish its hegemony on the international arena a set of ways, including adapting international law according to its vision, and it has employed this approach during the negotiations for the establishment of the International Criminal Court by trying to impose a statute that enables it to control its decisions. its failure to achieve this made it embark on a hostile campaign against the court to undermine its functions, especially against its citizens involved in crimes committed on the territory that it invaded by it as part of its global war on international terrorism, adopting strategy to make those involved free from the court's jurisdiction Through this paper, the objective is to shed light on this strategy, and its applications in Afghanistan تنتهج الولايات المتحدة الامريكية لتثبيت هيمنتها على الساحة الدولية مجموعة من السبل من بينها تطويع القانون الدولي حسب رؤيتها ، وقد وظفت هذا النهج أثناء مفاوضات تأسيس المحكمة الجنائية الدولية من خلال محاولة فرض نظام أساسي يمكنها من التحكم في قراراتها ،لكن فشلها في تحقيق ذلك ودخول نظام أساسي رفضت التوقيع عليه حيز النفاذ جعلها تشرع في شن حملة عدائية ضد المحكمة لتقويض وظائفها لاسيما إزاء رعاياها المتورطين في الجرائم المرتكبة على الأراضي التي غزتها في إطار حربها العالمية على الإرهاب الدولي ،حيث عمدت في ذلك الى تبني استراتيجية لجعل هؤلاء المتورطين بمنأى عن الولاية القضائية للمحكمة . وسنحاول من خلال هذه الورقة إلقاء الضوء على هذه الاستراتيجية ،و إسقاط تطبيقاتها على الوضع في أفغانستان
