آلية إخطار المحكمة الدستورية دراسة تحليلية في التعديل الدستوري لسنة 2020 و القانون العضوي رقم 22-19.

الملخص
ساير المؤسس الدستوري الجزائري التطور الحاصل على أساليب الرقابة على دستورية القوانين، خاصة بعد إقراره لآلية الدفع بعدم الدستورية، وذلك من خلال تبنيه نمطا جديدا من الرقابة على دستورية القوانين، حيث استحدث في التعديل الدستوري لسنة 2020 مؤسسة دستورية رقابية جديدة هي المحكمة الدستورية، تكلف بضمان احترام الدستور وضبط سير المؤسسات ونشاط السلطات العمومية وتفعيل الرقابة على دستورية القوانين، وممارسة المحكمة الدستورية لوظائفها الرقابية تتوقف على آلية الإخطار حيث منح المؤسس الدستوري الجزائري سلطة الإخطار للعديد من الجهات الدستورية والتي حددها في نص المادة 193 من التعديل الدستوري الأخير، و يكون إما إخطارا وجوبيا أو إخطارا جوازيا، إن تطور الرقابة على دستورية القوانين هي هدف كل نظام، وذلك نظرا للأهمية والمكانة المرموقة التي تتبوؤها في بناء دولة القانون، لهذا كان لزاما إسنادها لهيئة تتوفر على شروط وعوامل تضمن استقلاليتها وحيادها. It is either an obligatory notification or a permissible notification. The evolution of control over the constitutionality of laws is the objective of each regime, This is in view of the importance and prestige it holds in building the State of law ; independence and impartiality .
