مقارنة بين الاختصاص التّحكيمي لسُلطات الضّبط الاقتصادي والتّحكيم التّجاري الدّولي

الملخص
الملخص: من الواضح أنّ المشرّعَ الجزائري منح لبعضِ سلطاتِ الضّبطِ الاقتصادي صلاحيةَ التّحكيم في المنازعات التي هي ضمنَ اختصاصاتها، إذْ تلجأُ في بعض الأحيان إلى القيام بهذا الإجراء بين الأطراف المتنازعة، حيث تختصُّ بها سلطاتٌ دون باقي السُّلطاتِ المستقلّة الأخرى، ولكن لابدّ من الانتباه وعدم الخلطِ بين التّحكيم والتّحكيم التّجاري الدّولي الذي تختصُّ به جهاتٌ معينة وذاتُ اختصاصٍ دولي وليس فقط محلي؛ فهي مؤسّساتٌ دوليةٌ مختصّة بالتّحكيم في المسائلِ التجارية. ومن خلال هذه الورقة البحثية، سنتعرّف على أهمِّ مواطنِ التّشابه بين الاختصاص التّحكيمي الذي تقوم به سلطاتُ الضّبط الاقتصادي والتّحكيم التّجاري الدّولي، توجد به امتيازاتٌ للأطرافِ المتنازعة لا توجدُ في تلك الموجودة في سلطات الضّبط الاقتصادي بالنّسبةِ للاختصاص التّحكيمي، حيث أنّ هذه الإجراءات قائمةٌ على إرادة الأطراف في اختيار من يشرفُ على حلّ النّزاع . Abstract: It is clear that the Algerian legislator has granted some powers of economic control the power to arbitrate disputes that are within its competence, as it sometimes resorts to carrying out this procedure between the parties to the conflict, where it is the competence of authorities without the rest of the other independent authorities, but it is necessary to pay attention and not to confuse arbitration with international commercial arbitration, which is specialized in certain bodies and has international competence and not only domestic, they are international institutions competent to arbitrate commercial matters, and through these The research paper will identify the most important similarities between the arbitral jurisdiction carried out by the authorities of economic control and international commercial arbitration in which there are privileges for the parties to the dispute that are not found in those in the authorities of economic control in relation to the arbitral jurisdiction, as these procedures are based on the will of the parties to choose who supervises the resolution of the dispute.
