الملخص
ملخص: يعد الفساد من أكثر الجرائم انتشارا ويهدد استقرار الدول، وبعد مصادقة الجزائر على اتفاقية الأمم المتحدة لمكافحة الفساد، وقصد الوقاية والمكافحة الفعالة لهذه الجريمة شرعت قانونا خاصا بهذه الجريمة الذي جاء بمجموعة من التدابير الوقائية والعقابية وأساليب التحري والهيئة المكلفة بالوقاية ومكافحة الفساد والتعاون الدولي واسترداد الموجودات. تقدم هذه الدراسة النقدية لقانون الوقاية من الفساد ومكافحته الجزائري مفهوم الفساد من حيث تعريفه وأسبابه، وتقييم مفصل لإجراءاته الوقائية والعقابية. وقد تَمَّ تقسيم هذه دراسة إلى محورين، يتناول المحور الأول الإطار النظري للفساد الإداري من حيث تعاريفه اللغوية واصطلاحية والقانونية وأسباب انتشاره. أما المحور الثاني، فتناول دراسة نقدية لمواد هذا القانون من حيث مدى دقة مصطلاحاته واختلاف المعنى بين النص العربي والفرنسي Corruption is one of the most widespread crimes and threatens the stability of countries. After Algeria ratified the United Nations Convention against Corruption, and in order to effectively prevent and combat this crime, it enacted a law for this crime, which came with a set of preventive and punitive measures, investigation methods, and the body in charge of preventing and combating corruption, international cooperation and asset recovery. This critical study of the Algerian Anti-Corruption Law presents the concept of corruption in terms of its definition and causes, and a detailed assessment of its preventive and punitive measures. This study has been divided into two axes, the first axis deals with the theoretical framework of administrative corruption in terms of its linguistic, idiomatic and legal definitions and the reasons for its spread. As for the second axis, it dealt with a critical study of the articles of this law in terms of the accuracy of its terminology and the difference in meaning between the Arabic and French texts.
