رقابة القاضي أثناء النظر في الدعوى المباشرة (دراسة في التشريع الجزائري)

الملخص
الملخص: تهدف وسائل المحافظة على الضمان العام للدائنين إلى حماية حقوق هؤلاء وتيسر لهم استيفائها من أموال المدين وهذا عندما يقوم هذا الأخير بتصرفات يسعى من ورائها إلحاق الضرر بحقوق الدائنين، وبذلك فإن الهدف من هذه الوسائل هو المحافظة على أموال المدين المتقاعس عن تنفيذ ديونه فهي تعتبر وقاية وحماية لحقوق الدائنين لأنها تخول لهم ضمانا عاما على أموال المدين ما عدا في حالة وجود حق أفضلية مقرر بمقتضى القانون، ويوجد إلى جانب الوسائل المقررة لحماية حقوق الدائنين وسيلة قانونية أخرى وهي الدعوى المباشرة التي لا يمكن إخضاعها لهذه الوسائل وإنما لها نظام قانوني خاص ومستقل وهو ما جعل قاضي الموضوع يملك سلطة في ممارسة رقابة قضائية استثنائية عليها سواء في جانبها الإجرائي أو الموضوعي، غير أنه يظهر أن هذه السلطة ليست مطلقة في جميع الأحوال بل تخضع لضوابط وقيود التي يفرض على القاضي مراعاتها أثناء نظره في الدعوى المباشرة المطروحة أمامه. Abstract: The means of maintaining the general security of creditors are aimed at protecting the rights of the creditors and facilitating their satisfaction from the debtors funds when the latter commits acts that seek to harm the rights of the creditors, thus the aim of these means is to preserve the funds of the debtor who fails to execute his debts as they are considered to protect the rights of creditors because they give them a general security on the debtors funds except in the case of a preferential right established by law, In addition to the means established to protect the rights of creditors there is another legal means namely direct action that cannot be has a special and independent legal system which made the trial judge have the authority to exercise exceptional judicial control over them whether in their procedural or substantive aspects, however it shows that this authority is not absolute in all cases but is subject to the controls and restrictions that the judge is required to observe during his consideration of the direct case brought before him.
