الملخص
ملخص: انتشرت في الأشهر القليلة الماضية العديد من الممارسات غير المشروعة التي يقوم بها الضباط والأعوان الاقتصاديين والمرتبطة بتخزين السلع والبضائع وتكديسها، الأمر الذي خلق ندرة في بعض المواد الأساسية كالزيت والحليب والسكر في الأسواق وتهافت المستهلكين على اقتنائها بشكل كبير من جهة وارتفاع أسعار هذه السلع والبضائع من جهة أخرى بالرغم من وجود العديد من الأليات القانونية المنصوص عليها في القوانين الخاصة بأحكام وإجراءات خاصة، إذ تعتبر مرحلة البحث والتحري، المرحلة الأولى والهامة في مسار ضبط هذا النوع من الإجرام، ويتضح ذلك من توسيع المشرع الجزائري من دائرة الأشخاص المؤهلون بالكشف والتحري عن جريمة المضاربة غير المشروعة، وخول لهم معاينة جريمة المضاربة غير المشروعة باعتبارها ذات الاختصاص العام في البحث والتحري، كما أعطى لأشخاص آخرين مهمة معاينة المضاربة غير المشروعة وهم يعتبرون أشخاص مؤهلون بموجب نصوص قانونية خاصة، مع منحهم سلطات فعالة عن التحقيق لإثباتها و بغرض التصدي لها ومكافحتها. : Abstract In the past few months, many illegal practices have spread by offices and economic agents related to the storage and stacking of commodités and goods, which has created a scarcity of some basic materials such as oil, milk and sugar in the markets, and the rush of consumers to acquire them greatly on the one hand, and the high prices of these commodities on the one hand. Others, despite the existence of many legal mechanisms stipulated in the law for spécial provisions and procedures, as the stage of research and investigation is considered the first and important stage in the path of controlling this type of criminality, and this is evident from the expansion of the Algerian legislator from the circle of persons qualified to detect and investigate the crime of non-speculation And authorized them to examine the crime of un lawful speculation as it is of general jurisdiction in research and investigation, and also gave other persons the task of examining illegal speculation and they are considered qualified persons according to spécial legal provisions, while granting them effective powers for investigation to prove it and for the . purpose of confronting and combating it
