الملخص
لقد أفرزت حداثة النشاط الاقتصادي للدولة أنماطا جديدة للتدخل في الاقتصاد،إما للعمل على الاقتصاد الخاص أو لإدارة القطاع العام الصناعي والتجاري،وهذا ضمن إطار القانون العام الاقتصادي. وعليه لم تعد الأساليب القانونية التي تم استخدامها وتطويرها من قبل تتوافق مع هذا النوع من التدخل، وعليه وجب البحث عن حلول جديدة، قواعد موضوعية جديدة، (مفاهيم، نظريات، نظام)، آليات جديدة للتحكم في المنازعات. ومن هذا المنطلق كان لابد من تجديد الإجراءات القانونية التي تستخدمها السلطة العامة في نشاطها الاقتصادي،وبالتالي البحث في مسألة خصوصية القانون العام الاقتصادي من خلال تنوع الحلول وتكيفها وخصوصيتها ضمن توجه للتكامل بين القانون والاقتصاد. The modernity of the state's economic activity has produced new patterns of intervention in the economy, either to work on the private economy or to manage the industrial and commercial public sector, and this is within the framework of public economic law. Accordingly, the legal methods that were used and developed before are no longer compatible with this type of intervention, and accordingly, it is necessary to search for new solutions, new objective rules (concepts, theories, system), new mechanisms for controlling disputes. From this standpoint, it was necessary to renew the legal procedures used by the public authority in its economic activity, and thus research the issue of the privacy of public economic law through the diversity of solutions, their adaptation and their specificity within a direction of integration between law and the economy.
