تقنية المحادثة المرئية عن بعد ومقتضيات المحاكمة العادلة خلال جائحة كوفيد 19 "دراسة على ضوء التشريع الجزائري"

الملخص
في ظلّ تعليق العمل القضائي بسبب جائحة كورونا، أصبحت الضرورة ملحّة لنهج مسار التقاضي عن بعد وذلك تيسيرا لمهام القضاء وتبسيطا للإجراءات بالاستعانة بوسائل التطوّر التكنولوجي مع ضمان حقوق المتقاضين أمام القضاء تحقيقا للعدالة والأمن الصحّي للجميع. وتحقيقا لهذا المبتغى صدر الأمر 20/04 المعدّل والمتمّم لقانون الإجراءات الجزائية لتفعيل وتوسيع نطاق تطبيق تقنية المحادثة المرئية عن بعد من جهة وضمان أكثر لحقوق المتقاضين، مقارنة مع القانون 15/03 المتعلّق بعصرنة العدالة والأمر 15/02 المعدّل لـقانون الاجراءات الجزائية اللذين تبنيا بدورهما هذه التقنية ولكن في نطاق ضيّق جدّا. لذلك أتت هذه الدراسة للبحث عن ضمانات المحاكمة العادلة وحقوق المتقاضين أمام القضاء عند استعمال هذه التقنية على ضوء هذه النصوص المستحدثة. الكلمات المفتاحية: جائحة كوفيد 19؛ المحادثة المرئية عن بعد؛ المحاكمة العادلة. *** Abstract: In light of the suspension of judicial work due to the Corona pandemic, the necessity has become urgent to approach the process of remote litigation in order to facilitate the tasks of the judiciary and simplify the procedures using the means of technological development while ensuring the rights of litigants before the judiciary in order to achieve justice and health security for all, and in order to achieve this order was issued 20/04 The amended and supplemented Code of Criminal Procedures to activate and expand the scope of the application of remote video chat technology on the one hand and to ensure more rights of litigants, compared to Law 15/03 related to the modernization of justice and Ordinance 15/02 amending the Code of Criminal Procedures, who in turn applied this technology, but in The scope is very narrow. so this study came to search for guarantees of a fair trial and the rights of litigants before the judiciary when using this technique in the light of recent texts.
