الملخص

ملخص المنظومة القانونية لحماية حقوق الطفل في الجزائر تعتبر على المستوى النظري منظومة قانونية وحقوقية راقية ومتكاملة وذات معايير عالمية، تعززها قيم المجتمع النابعة من الدين الإسلامي الحنيف الذي يولي الطفل رعاية كبيرة، لكن الواقع أثبت مع الأسف خاصة في السنوات الأخيرة قصور هذه المنظومة وعدم نجاعتها خاصة في ظل تنامي انتهاك أسمى حقوق الطفل وهو حقه في الحياة من خلال الانتشار المخيف لظاهرة اختطاف الأطفال ثم قتلهم على يد مختطفيهم علاوة على تنامي البطالة والفقر والتهميش والحرمان وما تمثله من تهديد مباشر لحقوق الأطفال، حيث أن معظم أسر الأطفال في وضعية صعبة تعاني باستمرار من التمييز والفقر والإقصاء الاجتماعي، وصعوبة التأقلم على العيش في مساكن مكتظة وغير لائقة. Abstract : The legal system for the protection of children’s rights in Algeria is, in theory, a developed and integrated legal and human rights system with international standards, reinforced by the values of society stemming from the true Islamic religion, which gives great child care. Unfortunately, the reality, especially in recent years, has proven the inadequacy of this system and its ineffectiveness, especially in light of the growing violation of the higher rights of the child, which is his right to life, through the frightening spread of the phenomenon.
