القتل كمانع من موانع الميراث ( دراسة مقارنة بين الشريعة الإسلامية والقانون الجزائري)

الملخص
وضعت الشريعة الإسلامية نظام التوريث على أحسن النظم المالية وأعدلها، فقد جاء الدين الإسلامي بأحقية الإنسان في ملكيته للمال، وحدد أنصبة كل وارث، وقد نظم أحكام الميراث في حالة وفاة الوارث، كما حدد انتقال المال من الوارث المتوفي إلى المورث، وحتى التشريعات الوضعية حددت الشروط القانونية لانتقال الملكية العقارية عن طريق الإرث، ولكن هذه الملكية قد تصطدم بمانع يمنع فيها الوارث من الميراث، وهذا ما سنحاول دراسته من خلال ورقتنا البحثية، وذلك من خلال تخصيص دراستنا في تناول مانع من موانع الميراث التي تعترض الوارث من اخذ حقه، سواء في الشريعة الإسلامية والقانون، وكذلك محاولة معرفة أراء الفقهاء في سرد وتوضيح وبيان مواقفهم والأدلة التي استندوا إليها والتي اتفقوا عليها واختلفوا فيها، إضافة إلى توضيح ما تناوله المشرع الجزائري في قانون الأسرة الجزائري، ومعرفة ما إذا أخذ برأي الفقهاء أم اختلف عنهم Islamic Sharia has placed the system of inheritance on the best and fairest financial system. It also specified the transfer of money from the heir, the deceased heir to the heir, and even the man-made legislation specified The legal conditions for the transfer of real estate ownership through inheritance, but this ownership may run into an impediment in which the heir is prevented from inheriting, and this is what we will try to study through our research paper, by dedicating our study to one of the barriers to inheritance that obstructs the heir from taking his right, both in Islamic Sharia And the law, as well as an attempt to know the first jurists in listing, clarifying and clarifying their positions and the evidence they relied on and on which they agreed and disagreed, in addition to clarifying what the Algerian legislator dealt with in the Algerian family law, and knowing whether he took the opinion of the jurists or differed from them.
