الحماية الجزائية للأموال العقارية الخاصة في ظل التشريع الجزائري

الملخص
ملخص: تعتبر الملكية العقارية من بين المسائل التي اهتمت بها التشريعات قديما وحديثا، نظراً لدورها الوظيفي في المجتمع، إذ أصبحت اللبنة الأساسية لاقتصاد أي دولة في تحقيق التنمية. فالمشرع الجزائري مشى مجرى باقي التشريعات، فنظم مجال الملكية العقارية ونص على حمايتها دستوريا، إذ وضع لها نصوصاً خاصة لمعاقبة المعتدين عليها سواء في قانون العقوبات أو نصوص أخرى، حفاظاً على النظام العام للدولة، ووضع حداً لتجاوزات الأفراد كأخذ حقوقهم بأنفسهم. فأمام عدم وجود سياسة عقارية واضحة لدى المشرع، ونظراً لوجود كم هائل من القوانين المنظمة للملكية العقارية، وبالرجوع لأهمية الموضوع البارزة، ارتأينا تسليط الضوء على موضوع الحماية الجزائية للملكية العقارية في ظل التشريع الجزائري، وذلك لإبراز جل الجرائم الواقعة على العقار والعقوبات التي سلطها المشرع لردع المعتدين وتوفير عنصر الائتمان والضمان للملكية العقارية. Abstract : Real estate ownership is among the issues that have been the concern of legislation in the past and in the présent, due its functionl role in society, as it has becom the base of any country’s economy in achieving development . The Algérien legislator followed the course of the rest of the legilation, regulating the field of real estate ownership and providing for its contitutionl protection, as he put special preserve the public order of the state, and put an end to the transgressions of individuals such as taking their themselves . In view of the lack f aclear real estate policy on the part of the legislator, and of the persenc of a huge amount of laws regulating real estate ownership, and with reference to the prominent importance of the subject, we decided to shed light in the issue of criminl protection of real estate ownerdhip in the light of Algerian legislation, to highlight most of the crimes committed against real esate and the penalties imposed by the legislator to deter the aggressors in addition to the provision of credit and security for real esate ownership.
