الملخص
لقد نص تعديل دستوري 2020في ديباجته على تكريس فكرة امن قانوني وضرورة تنظيم وتقييد حريات بقانون وتكريس جودة نصوص قانونية وابتعاد عن تضخم تشريعي فمامدى فعالية هذه تعديلات واثرها على تعزيز حقوق وحريات أساسية تهدف هذه دراسة لمعرفة مدى تاثير تنظيم قانوني للحريات الأساسية في تعزيزها باعتبار ان البرلمان هو معبر عن إرادة عامة خلال قراءة المادة 34 من تعديل الدستوري 2020 تلزم احكام دستورية ذات الصلة بالحقوق الأساسية والحريات العامة وضمانااتها لا يمكن تقييد الحقوق والحريات والضمانات الا بموجب قانون ولأسباب مرتبطة بحفظ النظام العام والامن ، وحماية الثوابت الوطنية وكذا تلك الضرورية لحماية الحقوق والحريات أخرى كرسها الدستور . في كل أحوال لا يمكن ان تمس هده القيود بجوهر الحقوق والحريات الكلمات المفتاحية: امن قانوني تنظيم حريات تقييد تنظيم قانون Abstract: The 2020 constitutional amendment stipulated in its preamble to devote the idea of legal security and the need to regulate and restrict freedoms by law and to devote the quality of legal texts and to stay away from legislative inflation. This study aims to find out the extent to which a legal regulation of basic freedoms affects their promotion, given that Parliament is an expression of a general will. During the reading of Article 34 of the 2020 Constitutional Amendment, constitutional provisions related to basic rights and public freedoms and their guarantees are required. Rights, freedoms and guarantees can only be restricted by law and for reasons related to preserving Public order and security, and the protection of national constants, as well as those necessary to protect other rights and freedoms enshrined in the Constitution.
