ضمانات الاستثمار في اطار القانون 22-18

الملخص
عرفت الجزائر ومنذ الاستقلال مجموعة من القوانين وفقا للدساتير المتعددة تعاقبت على تأطير الاستثمار والتي أظهرت عدة نقائص وثغرات مما أدى إلى تغيير التوجه الاقتصادي بصفة عامة والاستثماري بصفة خاصة تماشيا مع ما جاء في دستور نوفمبر 2020، وذلك بمراجعة الاطر القانونية ومحاولة توفير بيئة استثمارية أكثر جاذبية لاستقطاب المستثمرين. وتعد التشريعات الاستثمارية أداة الدولة لتشجيع الاستثمار من خلال الضمانات القانونية والحوافز المالية التي تساهم في خلق المناخ الملائم للمستثمرين، وتهدف هذه الورقة البحثية إلى عرض أهم الضمانات التي جاء بها قانون الاستثمار رقم 22_18 تزامنا مع حاجة الدولة للنهوض بالاقتصاد الوطني ومواكبة القوانين من أجل استرجاع ثقة المستثمرين وذلك من خلال الضمانات المتعلقة بمنح حقوق وامتيازات وحوافز مالية للمستثمر، بالإضافة إلى الضمانات المتعلقة باستحداث آليات جديدة للاستثمار. وخلصت الدراسة بان قانون الاستثمار رقم 22_18 جاء بعدة ضمانات و امتيازات تمثلت في إعادة هيكلة الأنظمة التحفيزية للاستثمار وتوجيهها نحو القطاعات ذات الاولوية مع تعزيز مهمة الترويج والمرافقة. الكلمات المفتاحية: الاستثمار، الضمانات، تشجيع الاستثمار. Abstract: Since independence, Algeria has known a set of laws in accordance with the various constitutions, successively framing investment, which showed several shortcomings and gaps, which led to a change in the economic orientation in general and the investment orientation in particular, in line with what was stated in the November 2020 constitution, by reviewing the legal frameworks and trying to provide A more attractive investment environment to attract Investment legislation is the state's tool to encourage investment through legal guarantees and financial incentives that contribute to creating a suitable climate for investors. Investors, through guarantees related to granting rights, privileges and financial incentives to the investor, in addition to guarantees related to the development of new mechanisms for investment. The study concluded that the Investment Law No. 22_18 came with several privileges represented in restructuring the incentive systems for investment and directing them towards priority sectors while strengthening the task of promoting and accompanying investments.
