خلية معالجة الاستعلام المالي في الجزائر: أي مكتسبات في الفعالية في المرسوم التنفيذي رقم 22/36؟

الملخص
بعد توجه الاهتمام على المستويين الدولي والمحلي في سنوات سابقة لإنشاء جهات متخصصة بغض النظر عن التسمية التي تعتمدها كل دولة لها في نصوصها القانونية، لتتولى مهمة مكافحة جريمة تبييض الأموال وتمويل الإرهاب، سعيا لمنع الجماعات الإرهابية من تنفيذ نشاطاتها الإرهابية وتمويلها، قام المشرع الجزائري بإنشاء خلية معالجة الاستعلام المالي سنة 2002، تتولى معالجة المعلومات المالية وتحليلها وإبلاغ السلطات المختصة بشأنها، بالتكامل مع دور الهيئات الأخرى المختصة بمكافحة الفساد وتبييض الأموال وتمويل الإرهاب. لضمان فعالية دور خلية معالجة الاستعلام المالي عدل المشرع في النص المنظم لها سنة 2022، وقد حاولنا تقييم جديد هذا النص في الفعالية هل هناك مكتسبات جديدة فيه تدعم دورها كسلطة إدارية مستقلة؟، لاسيما أن المشرع تخلى عن تكييف السلطات الإدارية المستقلة في بعض هيئات الضبط المستقلة، بعد أن شهد في فترة سابقة توسعا في إنشائها، كما سنتولى دراسة استقلاليتها في ممارستها لمهامها، لما لها من تأثير مباشر على كفاءتها في المهام المنوطة بها. Given the growing national and international interests to create entities that deal with money laundering and prevent terrorist organizations from carrying out their illicit activities and unlawful financial transactions, the Algerian legislator has created a Financial Inquiry Processing Cell (FIPC) in 2002. This unit is responsible for analyzing the financial information and reporting to competent authorities and other money laundering matters services and supervisory bodies in combating terrorist financing. Moreover, the Algerian legislator amended the text regulating the FIPC, in 2022, to ensure its effectiveness. Therefore, this paper comes to shed light on the content of this text and investigate the potential benefits that support the FIPC role as an independent administrative authority. Especially that the Algerian legislator has lately abandoned the adaptation of the independent administrative authorities after the unremitting expansion of their establishment. Furthermore, the present paper attempts to study of the independence of the FIPC in performing its tasks and the subsequent impact on its efficiency.
