الضوابط التّداولية المُشكّلة لدلالة التّكليف الحَقيقية عند الأصوليين.

الملخص
ملخص: يحاول هذا البحث الوقوف على جملة الضوابط والعناصر التّداولية التي اعتمدها علماء أصول الفقه كمعايير للتّميز بين الدلالات الحقيقية والمجازية للخطاب التكليفي، والتي يمكن إجمالها في سبعة ضوابط أساسية، منها ما يرتبط بالوضع اللغوي باعتبار الخطاب التكليفي قولاً دالاً على الطّلب من الغير، ومنها ما يتعلق بسياق الكلام ومقامه من حيث صدور الخطاب من الأعلى إلى الأدنى في سياق الاستعلاء ممّا يشعر بوجوب الطاعة، كما منها ما يرتبط بمقصدية المتكلم من حيث إرادة الفعل أو كراهته. الكلمات المفاتيح: التداولية، الأمر، النّهي، الأصوليين. Abstract : This research is a contemporary linguistic study, examining the criteria adopted by the scholars of jurisprudence to distinguish between the real and unreal meanings of the command and prohibition, which relate to the linguistic situation, context, and what the speaker intende, The research also seeks to uncover the basis of disagreement between them in determining the real meaning of the formulas of order and prohibition. Résumé: Cette recherche est une étude linguistique contemporaine qui examine les critères retenus par les spécialistes de la jurisprudence pour faire la distinction entre les significations réelle et irréelle du commandement et de la prohibition, qui se rapportent à la situation linguistique, au contexte et à ce que le locuteur parle. La recherche vise également découvrir le fondement du désaccord entre eux pour déterminer le sens réel des formules d'ordre et de prohibition.
