الملخص
الملخص: نظام وقف تنفيذ العقوبة هو من بدائل العقوبات السالبة للحرية، منح كامتياز للقاضي الجزائي لتعليق تنفيذ العقوبة في حق المحكوم عليه لمدة محددة قانونا، وذلك بقصد تجنب سلبيات الحبس قصير المدة، عرف هذا النظام العديد من الصور، ولتقريره لابد من توفر مجموعة من الشروط منها ما هو شكلي، ومنها ما هو موضوعي، إلا أنه في المقابل يخضع لتقدير قاضي الموضوع وسلطته في الأخذ به أم لا، وتترتب عند تقريره مجموعة من الآثار وهي في المدة المقررة قانونا لنفاذه وإمكانية رد الاعتبار بعد انتهاء المدة المطلوبة، ومن الآثار كذلك توفر الأسباب الدافعة لإلغائه وتنفيذ العقوبة في حال إخلال المحكوم عليه المستفيد منه بالواجبات الملزمة له التقيد بها، وللإشارة فنظام وقف تنفيذ العقوبة يمتلك من المزايا والمحاسن المشهود له بها، إلا أنه لم يسلم من النقد في العديد من الجوانب، وهذا هو حال العلوم الإنسانية كونها لا تصل لليقينية حتى تزيل الشك والنقد التي تتعرض لها. Abstract : The suspension system is one of the alternatives to freedom-depriving penalties, granted as a privilege to the criminal judge to suspend the execution of the penalty against the convict for a legally defined period, with the aim of avoiding the negatives of short-term imprisonment. It is formal, including what is objective, but in return it is subject to the estimation of the subject judge and his authority to take it or not. When he decides, a number of effects arise and are within the legally prescribed period for its enforcement and the possibility of rehabilitation after the expiry of the required period, and among the effects are also the availability of reasons motive for its cancellation. And the execution of the penalty in the event that the convict, the beneficiary of it, violates the duties that he is obliged to abide by, and for reference, the system of suspending the execution of the penalty possesses of the well-known advantages and advantages, but it has not been spared from criticism in many aspects, and this is the case of the humanities as it does not reach certainty until it is removed Doubt and criticism.
