آلية الدفع بعدم الدستورية في النظام الدستوري الجزائري - The Exception Of Unconstitutionality Mechanism In The Algerian Constitutional System

الملخص
تعد الرقابة الدستورية حلا قانونيا هاما لضمان سيادة الدستور لحراسة النظام الديمقراطي وحماية حقوق الانسان, وبذلك أصبحت سمة بارزة في أي دستور جديد .لكن وبسبب محدودية هذه الرقابة الدستورية عبر مختلف الدساتير في الجزائر أقر المؤسس الدستوري الجزائري من أجل سد بعض الثغرات وتدعيم دولة القانون, ومن خلال التعديل الدستوري لسنة 2016 تغييرات تتعلق بتشكيلة المجلس الدستوري ثم بتوسيع صلاحياته وذلك بالتنصيص صراحة على اختصاصات جديدة تتعلق بإمكانية النظر في كل دفع بعدم دستورية قانون أثير أثناء النزاع القضائي. ثم ومن خلال التعديل الدستوري لسنة 2020 تم وضع خطوة هامة في تعزيز التوجه نحو القضاء الدستوري وذلك بظهور المحكمة الدستورية كهيئة مستقلة يتم من خلالها تكريس آلية الدفع بعدم الدستورية باعتبارها أحد أهم آليات الرقابة الدستورية البعدية التي تخول للأفراد طرح مسألة عدم دستورية قانون ما. Constitutional censorship is an important legal solution to ensure the rule of the Constitution to guard the democratic system and protect human rights, thus becoming a prominent feature of any new Constitution. However, because of the limitations of this constitutional censorship across Algeria's various constitutions, the Algerian constitutional founder The Algerian founder made some changes to plug the gaps and strengthen the state of law,these changes are related to through the Constitutional Amendment of 2016, the changes are related to the composition of the Constitutional Council and the extension of its powers by explicitly stipulating new terms of reference Concerning the possibility of considering any argument of unconstitutionality of a law raised during the judicial dispute Through the Constitutional Amendment of 2020, an important step has been made in strengthening the orientation towards constitutional justice This is due to the Constitutional Court's emergence as an independent body through which the mechanism for the defence of unconstitutionality is enshrined as one of the most remote constitutional control mechanisms empowering individuals to raise the question of the unconstitutionality of some law.
