حظر ممارسة البيع بسعر منخفض تعسفيا وفقا للأمر 03-03 المتعلق بالمنافسة

الملخص
يعتبر البيع بسعر منخفض تعسفيا ممارسة مقيدة للمنافسة أخضعها المشرع الجزائري للحظر القانوني طبقا لنص المادة 12 من الأمر 03-03 المتعلق بالمنافسة، ولم يشترط لذلك تحقق البيع فعلا فمجرد العرض يكفي طالما أن سعر المنتوج يقل كثيرا عن تكاليف الإنتاج أو التحويل أو التسويق، و بالنظر الى الآثار السلبية لهذه الممارسة التي يهدف أطرافها إلىإبعاد المؤسسات المنافسة من السوق المعنية أو عرقلة دخول منتجاتهمإليه مما يلحق ضررا بتلك المؤسسات وبالمستهلك بشكل غير مباشر وبالاقتصاد الوطني بصفة عامة، ولم يشترط المشرع تحقق تلك الآثار لتطبيق الحظر القانوني فبمجرد أن تهدف الممارسة أو يمكن أن تؤدي إلى تحقيق تلك الآثار تعتبر محظورة مما يدل على خطورتها و تقييدها للمنافسة الحرة في السوق. Abstract Selling at an arbitrary low price is considered a practice restricting competition, which the Algerian legislator has subjected to a legal ban in accordance with the provisions of Article 12 of Ordinance 03-03 related to competition, and it was not required for this to actually be realized.
