اختصاص المحكمة الجنائية الدولية في متابعة مرتكب جريمة تجنيد الأطفال زمن النزاعات المسلحة

الملخص
يشترك الأطفال كغيرهم في الحقوق الإنسانيّة المحميّة مع الأشخاص الآخرين كافّة التي يتولى القانون الدولي الجنائي حمايتها، لذا فان طبيعة هذه الدراسة نظرية في ظل النصوص و الإتفاقيات الدولية و بعض القرارات القضائية الدولية، و تتمثل أهداف الدراسة في ابراز تعدد الأخطار التي تتعرض لها الطفولة أثناء النزاعات المسلحة الدولية. كما ان منهج هذا البحث اعتمد بشكل أساسي على المنهج الوصفي التحليلي في تناول النصوص و الاتفاقيات الدولية لإبراز اهم الأحكام و القرارات التي لها صلة مباشرة أو غير مباشرة بالموضوع. كما ان اهم النتائج المتوصل اليه تتمل في الحماية التي وفرتها المحكمة الجنائية الدولية لهاته الفئة الحساسة في المجتمع الدولي عن طريق تجريم هاته الأفعال وفق نظام روما الأساسي و تحديد العقوبات المقررة لهاته الأفعال و تبيان الأجهزة المكلفة بالملاحقة و الحكم و تنفيذ العقوبات على منتهكي هاته القواعد. Children, like others, share protected human rights with all other persons protected by international criminal law, The study's nature is therefore theoretical under international texts, conventions and certain international judicial decisions, and the aims of the study are to highlight the multiplicity of dangers that children face during international and non-international armed conflicts from killing. The methodology of this research has also been based primarily on the analytical descriptive approach to international texts and conventions to highlight the most important provisions and decisions directly or indirectly relevant to the subject. The most important findings of the ICC's findings include the protection of the sensitive group in the international community by criminalizing such acts in accordance with the Rome Statute, establishing the penalties for such acts, and identifying the bodies responsible for prosecuting, sentencing and carrying out the penalties for those who violate
