أسباب وعوامل تفاقم أزمة العدالة الجنائية في الجزائر

الملخص

تستوجب الأزمة التي يعيشها القانون ومعه العدالة، البحث عن نموذج آخر للعدالة، يقوم على تكريس الطرق البديلة لتسوية النزاعات، يتعين على الدولة، في ظله أن تتبنى نماذج وأنماط جديدة في مجال الضبط الاجتماعي. ببقاء قانون العقوبات السلاح الوحيد الضابط للعلاقات والسلوكيات في المجتمع، فيما يتعلق بمصالح المجتمع الأساسية وحمايتها من كل خطر أو اعتداء، والوسيلة المفضلة لضبط الاستخدامات السلبية لما يفرزه العصر من تطورات، فإن ظاهرة التضخم التشريعي ستظل قائمة، وتظل سبب إعاقة جهاز العدالة. The crisis of law and justice requires the search for another model of justice, based on the establishment of alternative modes of conflict resolution, in which the State must adopt new models and types of social control. The Penal Code remains the only weapon that governs relations and behaviour in society, as regards the fundamental interests of society and its protection against any threat or attack, and the privileged means of controlling the negative uses of current developments, the phenomenon of legislative inflation will persist and continue to hamper the justice system.
