الملخص: يعد الالتزام بالتسبيب أحد الركائز الأساسية التي تحكم العملية القضائية التي تأخذ بها الأنظمة القانونية المتقدمة في سبيل الوصول إلى العدل، وأن إعمال هذا الالتزام يوجب على قاضي الموضوع بيان أسباب الحكم الذي يصدره وفق قواعد يكون من شأن إتباعها ألا يطال حكمه شائبة القصور في التسبيب بما يحقق العدل الذي يرضي الخصوم وينشده المجتمع ومما يجعله بمنأى عن الطعن. Abstract : The commitment to causation is one of the basic pillars that adjust the judicial process that the advanced legal systems take in order to reach justice, and that the implementation of this obligation requires the subject judge to explain the reasons for the judgment he issues according to rules that are to be followed so that his judgment does not affect the flaw in causation in order to achieve The justice that satisfies the opponents and is sought by society, which makes it immune to cassation .
