حق المرأة في مزاولة النشاط التجاري The Right Of Women To Engage In Commercial Activity

الملخص

تتمتع المرأة بحقها في مزاولة النشاط التجاري مثلها مثل الرجل، سواء كانت متزوجة أم غير متزوجة، وفي ذلك لا تحتاج لا إلى ترخيص من وليها في حالة عدم زواجها ولا لترخيص من زوجها في حالة زواجها، فلها ذمة مالية مستقلة عن الذمة المالية لزوجها، وتكون مسؤولة شخصيا عن أفعالها دون أن تمتد هذه المسؤولية لهذا الأخير. إذ بمجرد كمال أهليتها تكون حرة في احتراف النشاط التجاري (تشتري وتبيع، تحرر سفتجة، تنشأ شركة، ... إلخ)، ما يجعلها تكتسب الصفة التجارية وتخضع لالتزامات التاجر كمسك الدفاتر التجاري والقيد في السجل التجاري. Woman enjoys the same right to engage in commercial activity as man, whether she was married or unmarried, In that, she does not need a license from her guardian in the event of her unmarriedness, nor a license from her husband in the event of her marriage, as she has a financialliability independent of the financialliability of her husband. She shall bepersonally liable for its actions without extending this responsibility to this last, As soon as she is complete eligibility, she is free to engage in commercial activity (buying and selling, issuing a draft, establishing a company, ... etc.), What makes itacquire a commercial character and issubject to the obligations of the merchant, such as keeping commercial books and registration in the commercial register.
