الجوانب القانونية والاجتماعية لجريمة القذف في الفقه الإسلامي

الملخص
ملخص: اهتمت جميع الشرائع السماوية والقوانين الوضعية بالحفاظ على الأسرة باعتبارها الحصن الحصين لبناء مجتمع متماسك، وذلك بحمايتها بكل ما يمس سمعة أفرادها وشرفهم وأعراضهم، كالقذف أو السب وغيرهما. ويعد القذف من الآفات المنتشرة بكثرة في مجتمعاتنا، وعلى هذا الأساس، أعارته الشريعة الإسلامية عناية خاصة نظرا لخطورته، ولحرصها على توفير الحماية المعنوية والأدبية لشخصية الإنسان في كرامته واعتباره وقيمته، فعالجت القذف بتجريمه ووضع العقوبة المناسبة له. يتناول هذا البحث جريمة القذف في الفقه الإسلامي وما يترتب عليها من عقوبة، كما يهدف إلى توضيح مفهومها، وبيان أحكامها، مع تشخيص الأسباب التي تؤدي إلى ارتكاب مثل هذه الجرائم والأضرار الناجمة عنها، لمحاولة التوصل بالأسرة والمجتمع إلى الابتعاد عنها وخلوهما من مفاسدها. Abstract: All divine laws and positive laws are concerned with preserving the family as the cement of a cohesive society, protecting it from anything that can affect the reputation, the honor of its members, such as defamation, slander or insult. Defamation is one of the most widespread scourges in our societies and, on this basis, Islamic law has given it special attention given its seriousness and its concern to provide moral protection to human personality in its dignity, consideration and worth, so that it has worked to combat the scourge of defamation by criminalizing it and imposing appropriate penalties. This research deals with the offense of defamation in Islamic jurisprudence and the penalties resulting from it. It also aims to clarify its concept and explain its provisions, as well as to diagnose the causes that led to the commission of such crimes and the resulting damage, in an attempt to distance the family and society to stay away from it.
