التمذهب الفقهي بين الملزمين والرافضين

الملخص
تهدف هذه الدراسة إلى بيان معنى التمذهب الفقهي، ومن يدخلون تحت مصطلح التمذهب الفقهي، مع سرد أقوال الفقهاء والأصوليين في حكم التمذهب الفقهي، وبيان أدلة كل فريق منهم مع مناقشتها إن وجدت، ثم بيان المذهب الراجح في المسألة، في دراسة موضوعية بعيدة عن كل أشكال النمطية، وقد خلصت الدراسة إلى أن التمذهب خاص بالمجتهدين، أو من هو دونهم ممن ارتقى عن رتبة العامي، وتوصلت الدراسة أيضا إلى أن المذهب الوسط في المسألة، وهو مذهب المجيزين للتمذهب هو المذهب الراجح وهو مذهب الأكثر، كما أن البعض من كلا الطرفين قد سلكوا مسلك الغلو، إما بالتعصب المذهبي للملزمين بالتمذهب، أو التعصب اللامذهبي للرّافضين للتمذهب، وكلا الأمرين مردود. This study aims to clarify the meaning of follow a juristic doctrine, and those who enter under the term of follow a juristic doctrine, with narration of the sayings of jurists and origins scientists in the rule of follow a juristic doctrine, and to explain the evidence of each of them with discussion if any, then to indicate the correct doctrine in the matter, in an objective study far from each typical forms, and the study concluded that the follow a juristic doctrine is specific to the diligents, or who is below them who rose from the rank of the commoner, and the study also concluded that the middle doctrine in the matter, which is the permissible doctrine of follow a juristic doctrine is the most correct doctrine and is the doctrine of the most, as some of both parties have walked excessive behavior, either with sectarian doctrinal bigotry to doctrine, Or the non- doctrinal bigotry of those who refuse to go to doctrine, and both are rewarded
