تجريم التمييز وخطاب الكراهية وفقا للتشريع الجزائري والاتفاقيات الدولية

الملخص
إن انتشار خطابات التمييز والتحريض على الكراهية والعنف داخل المجتمع قد يؤدي إلى زعزعة استقراره وانسجامه ووحدته، فاللجوء إلى استخدام ألفاظ وعبارات بصور متنوعة ومن مصادر متعددة تندرج تحت مسميات مختلفة هو محاولة للتستر على ما يسمى جرائم تشكل تمييزا وخطابا ينشر الكراهية بين أفراد المجتمع الواحد، خصوصا مع تطور وسائل التواصل التقنية وسهولة استعمالها، والتي كان لها دور كبير في انتشار أفكار وخطابات تنطوي على تمييز وتدعو إلى الكراهية. وسعيا من المشرع الجزائري للحد من انتشار أفكار التمييز وخطابات الكراهية، بالإضافة إلى ما نص عليه الدستور وما تضمنته الاتفاقيات الدولية المصادق عليها والقوانين الداخلية ذات الصلة، تدخل من خلال إصداره للقانون 20-05 المتعلق بالوقاية من التمييز وخطاب الكراهية ومكافحتهما، محاولا معالجة هذه الظاهرة من خلال استحداث آليات وقائية وأخرى عقابية، واضعا إطارا قانونيا لتجريم كل ما يتعلق بالتمييز وخطاب الكراهية في المجتمع الجزائري. The spread of discourses of discrimination and incitement to hatred and violence within society may lead to destabilization, harmony and unity. Resorting to the use of words and phrases in various forms and from multiple sources that fall under different names is an attempt to cover up the so-called crimes that constitute discrimination and a discourse that spreads hatred among members of the same community, especially With the development of technical means of communication and their ease of use, which played a major role in the spread of discriminatory and hateful ideas and speeches. In pursuit of the Algerian legislator to limit the spread of ideas of discrimination and hate speech, in addition to the provisions of the Constitution and the contents of ratified international conventions and relevant internal laws, it intervened through its issuance of Law 20-05 related to the prevention and combating of discrimination and hate speech, trying to address this phenomenon from Through the development of preventive and punitive mechanisms, establishing a legal framework to criminalize everything related to discrimination and hate speech in Algerian society.
