الملخص
ملخص: لقد عرفت الجزائر منذ صدور دستور 1989 تحولات ضمن المجال الاقتصادي، وهذا بتوجهها نحو اقتصاد السوق والتخلي عن النظام الموجه، ولكن انسحاب الدولة من المجال الاقتصادي لا يعني تماما نهاية تدخل السلطة العمومية في هذا المجال، ومن أجل تحرير القطاعات الاقتصادية التي كانت حكر للدولة فقط وفتح النشاطات للمنافسة تم إحداث سلطات ضبط مستقلة، وهو ما يهدف إلى تكريس أحد المبادئ الأساسية لاقتصاد السوق المتمثل في ضمان الفصل بين الدولة كمتعامل والدولة بصفتها ضابط للسوق. وتأتي دراستنا لتوضيح الرخص الإدارية الممنوحة من طرف السلطات الإدارية المستقلة في إطار ممارسة سلطة الضبط الاقتصادي، ومدى خضوعها للرقابة القضائية كضمانة وضعها المشرع للمتعامل الاقتصادي. Abstract: Since the 1989 Constitution, Algeria has experienced changes in the economic field, and this was due to its movement to the market economy and the abandonment of an oriented system, But the withdrawal of the State from the economic field does not exactly mean the end of public intervention in this area , In order to liberalize the economic sectors that were the exclusive monopoly of the State and open up activities for competition, independent powers of control have been created, This aims to dedicate one of the fundamental principles of the market economy, which is to ensure the separation of the State as a dealer from the State as a market officer. Our study is intended to clarify the administrative licences granted by the independent administrative authorities in the exercise of economic control power and the extent to which they are subject to judicial control as a guarantee to economic agents by the legislator.
