الملخص
ثمّة قضايا فقهيّة لم تقع بعد وإنّما يطرحها الفقيه من باب تدريب أذهان الدّارسين حتّى يتسلّل إليهم شيء من الملكة الفقهيّة، أو يكون الدّافع لذاك الطّرح استغلال وجود شخصيّة فقهيّة بارزة تذلّل مشكلة تكييف النّوازل الفقهيّة العويصة، وقد قرّر بعض الفقهاء إباحة الاشتغال بما لم يكن بعد من مسائل للمتفقّهة لغرض التّفقّه والدّراسة وتعميق الفهم وتنمية الملكة، وهذا البحث يدعو المختصّين في الفقه الإسلامي خاصّة القائمين بتدريسه للنّاشئة إلى إحياء هذا النّمط من المسائل الافتراضيّة، جريا على عادة من سبق من الفقهاء الذين أثروا مسائل الفقه بعدد وفير من الفروع الافتراضيّة، التي كان لها أثر في تنمية الملكة الفقهيّة لدى الدّارسين، وذلك وفق ضوابط معيّنة ابرزها هذا البحث.
