حصر المقاصد ثابت بالنّظر للواقع وجار على وفق ترتيب الشرائع دراسة مقاصدية ورؤية حضارية

الملخص
البحث يكشف عن قضية انحصار المقاصد والترتيب الجاري به العمل عند المتقدمين والمتأخرين، وأن هذا الانحصار ثابت بالواقع، وأقره المتشرعة منذ أن بدأت حركة التصنيف في علوم الشريعة، وكان الاختلاف في ترتيبها له كبير أثر في التنزيل الفقهي؛ فترتيب الغزالي أولى عند الباحث من ترتيب الآمدي، وإن ظاهرة عدم التأليف في المقاصد عموما وفي بيان انحصارها دليل على أن الأمر فيها مسلم عندهم، فهي أشهر من أن تعرف أو يصنّف فيها. والبحث يعرض جهود العلماء في تحديد هذه الإشكالية التي مساحة التوافق والاعتقاد فيما بينهم هي الأقرب، كيف وأن سائر الملل وافقتنا على حصول التناسب في ترتيب الضروريات الخمس وكليات الشريعة على جهة الإجمال ولعلّ عدّ المعرفة بالمقاصد لدى المجتهدين هو سبب للاجتهاد وليس شرطا فيه عامل آخر مهم من عوامل عدم التأليف وذكر جميع مفردات هذا العلم الراسخ والمعرفة اليقينية. The research highlights the restriction of the purposes and the practical classification with the advanced and the latecomers ,this restriction is certain and it has been recognized by the legislators since the beginning of taxonomy in the religious knowledge and the disagreement on its classification has a big impact on jurisprudence applications; the classification of Alghazali is more favored than the classification of al-Amidi and the absence of authorship in ’ purposes’ is a sign that ,for them, they are well recognized and are, therefore, beyond any definition or taxonomy. This study exposes the efforts made by scholars in order to define the problem where compatibility among them is the most dominant , besides, all the sects agree on the proportionality in the classification of the five necessities in general. It is possible that the consideration of knowledge of purposes by scholars as a reason for the hardworking and not a condition is another factor for the absence of authorship and stating all the terms of this firm science and knowledge.
