الشروط الموضوعية لقبول دعوى الإلغاء ضد القرار الإداري المطعون فيه

الملخص
يقوم القضاء الإداري بدراسة ملف الدعوى المرفوعة أمامه بعد توفر مجموعة من الشروط الشكلية والموضوعية، ويهدف هذا البحث إلى دراسة هذه الشروط الموضوعية وتوضيح الحالات التي تتحقق فيها حتى يمكن الطعن في القرار الإداري. وقد تم التوصل إلى هذه الشروط والتي تتعلق بصحة المشروعية الخارجية المتعلقة بالقرار الإداري وهي وجود عيب في عنصر الاختصاص وعنصر الشكل والإجراءات، أما عدم المشروعية الداخلية، فتتمثل في عيوب القرار الإداري الموضوعية وهي عنصر السبب والمحل والغاية، فإذا شاب القرار الإداري أحد هذه العيوب أو أكثر، صار هذا القرار معرضا للطعن والإلغاء من طرف القضاء الإداري المختص، مما يتوجب على الجهة الإدارية مصدرة القرار إلغاؤه، وتقديم تعويض عند الاقتضاء. The administrative judiciary studies the case file brought before it after fulfilling a set of formal and objective conditions. And this research aims to study these objective conditions and clarify the cases in which they are achieved so that the administrative decision can be challenged. These conditions have been reached, which are related to the validity of the external legality related to the administrative decision, which is the presence of a defect in the element of competence and the element of form and procedures, and with regard to internal illegality, disadvantages of the administrative decision relating to its subject it is the element of reason, place and purpose, If the administrative decision contains one or more of these defects, this decision has become subject to contestation and cancellation by the competent administrative judiciary, which means that the administrative body issuing the decision must cancel it and award compensation where appropriate.
