النظام القانوني للمرافق العامة في ظل نظام اقتصاد السوق

الملخص
يعد موضوع المرفق العمومي، من المواضيع البالغة الأهمية في القانون الإداري فهو يمثل النشاط الإداري في شقه الإيجابي، اذ يعد نشاطا تتولاه الدولة او أحد الأشخاص المعنوية العامة او تعهد به لأشخاص من القانون الخاص تحت رقابتها وإشرافها بهدف اشباع حاجات ذات نفع عام، ويخضع المرفق العام لمجموعة من المبادئ المستقر عليها فقها وقضاءا او هي مبادئ مكرسة دستوريا تهدف الى حسن سير المرفق العام عن طريق خدمة المواطنين وتحقيق الصالح العام. وتبني الجزائر لنظام اقتصادي السوق الذي يعد أحد مقومات النظام الرأسمالي بموجب دستور 1989 حيث مس هذا النظام الجوانب الاقتصادية والسياسية، اذ تم الانفتاح على السوق والعولمة، فكان من الضروري الانتقال من طرق تسيير الكلاسيكية (التقليدية) الى الطرق الحديثة في ادارة المرافق العامة بما يتماشى والطبيعة الاقتصادية والاجتماعية والسياسية للدولة حيث أدى ذلك الى زيادة مردودية هاته المرافق تلبية للحاجات العامة للمواطنين وتحقيق لمتطلبات التنمية المستدامة. the subject of the public facility is a very important topic in administrative law . It represents administrative activity in a positive apartment. It’s an activity carried out by the state or a public moral person or pledged to people of the private law under its supervision with the aim of satisfying of public benefit. The public facility is subject to a set of principles on which it is settled and is governed by a judiciary and these are constitutionally enshrined principles aims to improve the functioning of the public facility by serving citizens and achieving the common good. Algeria adopted a mark et economy system, which is one of the components of the capitalist system under the 1989 constitution, this system touched the economic and political aspects as the market and globalization were opened up, it was atrophy moving from classic management methods to modern ways in the management of public facility in line with the economic and social and political nature of the state where this led to increase the efficiency of these facilities meet the general needs of the citizens to achieve the requirements of sues trainable development.
