أثر الإعراب ومعاني الحروف والإضافة في الشروح الفقهية - حاشية الباجوري نموذجا

الملخص
يهدف هذا البحث إلى دراسة مدى إفادة الفقهاء من الدرس النحوي -متمثلا في الإعراب ومعاني أل وحروف الجر والعطف والإضافة- في شرح العبارات الفقهية، وتيسير فهمها، واتخذ من حاشية العلامة الباجوري نموذجا للدراسة، واشتمل على: مقدمة، وتمهيد، وفصلين، وخاتمة، عرّف التمهيد بمتن أبي شجاع ومؤلفه، وشرحه لابن قاسم ومؤلفه، وحاشية الباجوري عليه ومؤلفها، ودرس الفصل الأول: أثر حروف المعاني والإضافة في أربعة مباحث، المبحث الأول: أثر أل المعرّفة، والثاني: أثر حروف الجر، والثالث: أثر حروف العطف، والرابع: أثر الإضافة، ودرس الفصل الثاني: أثر الإعراب، وتوصل البحث في خاتمته إلى: تمكن الفقهاء في علم النحو، وقدرتهم على تطبيقه على النصوص الفقهية، وإفادتهم من الدرس النحوي في شرح العبارات الفقهية وتوضيحها، وأن الباجوري طبق ذلك على متن أبي شجاع وشرحه لابن قاسم؛ فكان يستدل بالسياق على نوع الحرف، ويوظف معناه في شرح العبارة وتقرير الحكم الفقهي، وأفاد من الإعراب بمرفوعاته ومنصوباته ومجروراته وتوابعه في ذلك أيضا، وأضاف معاني جديدة لحروف المعاني يقتضيها السياق لم تذكرها كتب النحو، وأوصى البحث بعمل دراسات مشابهة لهذه الدراسة، تبرز أثر الدرس النحوي في الكتب التي ألِّفت في فروع العلم المختلفة. This research aims to study the extent to which the jurists benefit from the grammatical lesson: represented in the syntax, the meanings of Al ( the), prepositions, connectors (conjunctions), and addition, in: explaining jurisprudential phrases, and facilitating their understanding, The preamble is the text of Sheikh Bagouri an example for this study. It contains: An introduction, Preface,Two chapters, And a conclusion .The preface introduces Abi Shuja text, and its author. It also introduces: its explanation by Ibn Qasim and its author. Moreover; the footnote of al-Bagouri, and its author. The firs studies: The effect of Al (the), which specify the noun. The second one studies the effect of prepositions.The third: the effect of connectors (conjunctions: i.e. (and). The fourth: the effect of addition. The second chapter studies: the impact of parsing. The outcome of the research in its conclusion: the ability of the jurists in the science of grammar, and their ability to apply it to jurisprudential texts, and their benefit from the grammatical lessons in explaining and clarifying jurisprudential phrases, Also, one of the outcomes is hat: Al-Bagouri applied this on Abu Shuja text, and its explanation by Ibn Qasim. He takes the context, as a proof on the type of letter: (for example a preposition). He employees its meaning in explaining the phrase and deciding the jurisprudential ruling, and benefited from the parsing with its predicates, and its dependencies in that, as well. He adds new meanings to the letters of meanings which the context needs them; even though the grammatical books don't mention them. This research recommends that similar studies to this one, should be done. In order to clarify the effect of grammatical lesson on the books which are written in various knowledge branches .
