الفكر الأصولي المالكي بالأندلس وإسهامات الشاطبي في تطويره

الملخص
يتناول هذا البحث بيان مكانة علم أصول الفقه بالقطر الأندلسي، والتعريف بأهم خصائصه المعرفية؛ وهذا ببيان البنية الفكرية المكونة له سواء ما تعلق منها بالجانب الببليوغرافي أو المنهجي أو الموضوعي، لينتقل بعدها إلى بيان جهود الشاطبي في خدمة هذا الفكر والنهوض به وتطويره سواء من الجهة المنهجية بإبداعاته التي ضمَّنها كتابه الموافقات، أو الشقِّ الموضوعي وذلك بآرائه النيرة وأفكاره المبتكرة. وقد خلص إلى مجموعة من النتائج منها: أن الفكر الأصوليّ الأندلسيّ مر بمرحلتين: مرحلة ضعفٍ وقلّةٍ، ومرحلة توهّجٍ وقوّةٍ، ومنها أن المصنفات الأصوليّة الأندلسيّة تميزت بجملةٍ من الخصاص المنهجيّة والموضوعية المتنوّعة، ومنها أن الشاطبي تنوعت إسهاماته بين الإسهام المنهجيّ و الموضوعيّ، فكان له بذلك الفضل في النّهوض بعلم أصول الفقه في هذا القطر. Abstract: This research deals with the status of the science of jurisprudence in the Andalusian country, and the definition of its most important cognitive characteristics; This is by explaining the intellectual structure that composes it, whether related to thebibliographical, methodological or objective aspect, then moving on to explaining the efforts of Al-Shatibi in serving this thought, advancing it and developing it, whether from the methodological aspect with his creations included in his book Al-Muwafakat, or the objective part, with his bright opinions and innovative ideas He concluded with a set of results, including: The Andalusian fundamentalist thought went through two stages: a stage of weakness and lack, and a stage of brilliance and strength, including that Andalusian fundamentalist works were characterized by a set of various methodological and objective characteristics, including that Al- Shatibi's contributions varied between the methodological and the subject. Credit for advancing the science of jurisprudence in this country.
