الجمعيات الاجتماعية و الثقافية إشكالية التأسيس و الممارسة في ظل القانون الأخير 12/06 ولاية غليزان أنموذجا Social And Cultural Associations, The Problem Of Establishing And The Practice Under The Last Law 12/06 Relizane State As A Model

الملخص
ملخص: تهدف هذه الدراسة الى التعرف على واقع الجمعيات الاجتماعية و الثقافية في ولاية غليزان و احصائها ، والتي تم انشاءها منذ صدور القانون العضوى 12/06 المتعلق بالجمعيات و الذي يحدد كيفية تطبيق المواد القانونية و تنظيمها على نشاطات و اعمال الجمعيات في المجتمع ، و يتناول البحث اشكالية تأسيس هذه الجمعيات و ممارسة نشاطها في ظل المراقبة المفروضة عليها من طرف الدولة ، و هذا من خلال الاستطلاعات الميدانية و الادبية ، حيث يتعدى مفهوم الجمعية ليشمل الأبعاد الثقافية و الاجتماعية و السياسية ، لتؤثر في أنشطة الجمعيات من كل مناحي الحياة الاجتماعية من اجل تحقيق الاهداف المنشودة في المجتمع، و تظهر الدراسة أيضا المعوقات و الصعوبات التي ساهمت في اختفاء اكبر عدد من الجمعيات من الساحة الاجتماعية لعدم مطابقتها و مواد القانون ، وفي الاخير تمثلت نتائج الدراسة في كون مفهوم الجمعية متعدد الدلالات ، إذ تعتبر الجمعية هدفا اساسيا للأفراد في القطاعات المختلفة كالثقافية و الاجتماعية و الرياضية و الخيرية ......الخ ، المرتبطة بها و من النتائج ايضا ان القانون 12/06 كان له الأثر البليغ في اقصاء عدد كبير من الجمعيات نظرا للعراقيل و العوائق و الصعوبات التي حملتها مضامين مواد هذا القانون ، و اوصت الدراسة بالبحث و التنقيب و التفسير في القوانين المنظمة للجمعيات ، و اعادة النظر فيها من جديد حتى تتلاءم مع الظروف الراهنة و الاهتمام بها مع ضرورة اشراكها في القرارات السياسية للبلاد. Abstract : This study aims to identify the reality of social and cultural associations in the wilaya of relizane ; which has been regulated by the authority since the promulgation of Law 12/06 relating to associations ; and which shows the reality of applying the articles to the activities ; and the work of associations in society ; and the research addresses the issue of incorporation and practice; the activity and control imposed by the state ; and that to through investigations ground and literary surveys ; as going beyond the concept of association to include cultural dimensions ; social, and political, and the activities of associations have touched all aspects of social life ; in order to achieve the desired goals in society , and the study also shows the obstacles that have contributed to the disappearance of the greatest number of associations from the scene ; , because they do not comply with the articles of the law ; and the results of the study were that the concept of association is multi-connotation and is seen as a primary objective for all individuals in different sectors such as cultural, social, sports, and charitable ... etc ; associated with it, too, and the results are that Law 12/06 has had an eloquent effect in excluding a large number of associations due to obstacles ; and the difficulties that came from the articles of this law ; and at the end the study recommended to research, and to deepen, and to interpret the laws which organize the associations, and to reexamine them so that they adapt with the current circumstances and deal with them with the need to involve them in the political decisions of the country.
