حماية الشركات التجارية من البطلان

الملخص
ملخص: إن الطبيعة الخاصة لعقد الشركة التي ينبثق عنها شخص معنوي، يفترض فيها أنها عاشت فترة طويلة ودخلت في معاملات مع الغير، فرضت على المشرع عند تطبيقه نظرية البطلان إجراء بعض التحوير والحد منها من أجل ضمان إستمراريتها، حماية للمصالح الاقتصادية والإجتماعية التي يمكن أن تتعرض للإهدار والضياع من جراء هذا البطلان، نظرا للمكانة المهمة التي تحتلها الشركات التجارية في الحياة الاقتصادية والتجارية. Abstract: The special nature of the contract of the company from which a legal person emerges, in which it is assumed that it lived for a long time and entered into transactions with others, imposed on the legislator, when applying the theory of nullity, to make some modification and limit it in order to ensure its continuity, in order to protect the economic and social interests that could be wasted and Loss as a result of this nullity, given the important position occupied by commercial companies in the economic and commercial life of the state.
