الصلاحيات الإستشارية لرئيس مجلس الأمة على ضوء التعديل الدستوري لسنة 2020

الملخص
يعد رئيس مجلس الأمة الشخصية الأولى في مجلس الأمة بصفة خاصة، والشخصية الهامة والأبرز في الدولة بصفة عامة، نظرا للمكانة السياسية التي يتمتع بها، وباعتباره القائد الفعلي للعمل البرلماني، والذي يعمل على فرض النظام داخل المجلس والتوافق بين مختلف التشكيلات السياسية الممثلة في المجلس. حيث خوله الدستور تولي أعلى منصب في الدولة، وهو منصب رئيس الجمهورية وذلك في حالة حصول مانع له واستحالة ممارسة مهامه بسبب مرض خطير ومزمن، وكذا في حالة استقالته أو وفاته، وذلك بعد الإجراءات المحددة في التعديل الدستوري لسنة 2020. وخلصنا من خلال توضيح الدور الاستشاري لرئيس مجلس الأمة إلى أنه لم يكن من أجل خدمة العملية التشريعية فحسب، و إنما جاء كذلك من أجل تدعيم السلطة التنفيذية وعلى رأسها رئيس الجمهورية من خلال آرائه غير الملزمة. The president of the national assembly is the first person in the national assembly in particular, and the most important and prominent figure in the state in general, due to his political position as well as being the de-facto leader of the parliamentary action, who works to impose order within the Assembly and the consensus between the various political formations represented in the Assembly. Where the constitution authorized him to assume the highest position in the country, which is the position of the President of the Republic, in the event of an impediment to him and the impossibility of performing his duties due to a serious chronic illness, as well as in the event of his resignation or death, and that is after the procedures specified in the constitutional amendment for the year 2020. And we concluded by clarifying the advisory role that it was not only for the sake of serving the legislative process, but also came in order to strengthen the executive authority, headed by the President of the Republic, through his non-binding opinions.
