التناسب في إطار الدفاع المشروع

الملخص
يعتبر شرط التناسب من أدق الشروط المتطلبة في الدفاع المشروع، لذا اهتم الفقه والقضاء بهذا الشرط كثيرا لما له من أهمية بالغة في تحديد مصير الدعوى، والتناسب نوعان: عام يهدف إلى تحقيق التوازن بين فعل الدفاع والاعتداء، وخاص يهدف بالأساس إلى الحفاظ على حياة المعتدي، ويثور أيضا الحديث عن التناسب في إطار الدفاع الآلي وفي إطار الدفاع الممتاز، ولقد اجتهد الفقه كثيرا لإيجاد معيار لقياس التناسب، يحفظ حقوق المدافع والمعتدي على حد سواء، وفي حالة التجاوز نظم القانون عقوبات مخففة في حق متجاوز حد التناسب. Proportionality is one of the strictest conditions required in legitimate defense, so it has received considerable attention, namely, two types: general aimed at achieving balance, and especially for preserving the life of the aggressor. Talk of proportionality arises in the framework of automatic defense and in the framework of excellent legitimate defense. The jurisprudence has often strived to find a criterion for measuring proportionality, preserving both the rights of the defender and the aggressor, and in the event that the law exceeds the imposition of mitigating penalties towards the exceeding of the proportionality threshold.
