الرقابة على حسابات الحملة الإنتخابية (قراءة في الأمر 21-01 المتضمن القانون العضوي المتعلق بنظام الإنتخابات)

الملخص
إن لقضايا تمويل الحملات الانتخابية تأثير كبير على نوعية الإنتخابات، لذلك تدخل المشرع بموجب الأمر رقم 21-01 المتضمن القانون العضوي المتعلق بنطام الإنتخابات لضبط عملية تمويل الحملة الإنتخابية ومراقبتها، من خلال إخضاع حسابات الحملة الإنتخابية للمرشحين لرقابة لجنة مراقبة تمويل الحملة الإنتخابية لدى السلطة الوطنية المستقلة للإنتخابات والمنشئة لأول مرة بموجب هذا القانون، من أجل إيجاد التوازن مابين حاجتين: تحقيق حد أدنى من المساواة بين المترشحين، وضمان المشاركة في الإنتخابات للجميع دون ان تكون محدودية إمكانياتهم المادية عائقا لذلك من جهة، ومن جهة أخرى إجراء إنتخابات سليمة وصحيحة يسودها مناخ من الشفافية، وما يترتب عليه من شعور المواطن بأن صوته لا يباع ولا يشترى، وإنما هو صوت يتم منحه لمن يستحقه بغض النظر عن ما أنفقه المرشح. Résumé questions de financement des campagnes électorales ayant un impact significatif sur la qualité des élections, le législateur est intervenu par l'ordonnance n° 21-01 portant loi organique relative au régime électoral pour contrôler et surveiller le processus de financement des campagnes électorales en soumettant le comptes de campagne des candidats à la surveillance de la Commission de surveillance du financement des campagnes électorales de l'Autorité électorale nationale indépendante Créée pour la première fois en vertu de cette loi, afin de trouver un équilibre entre deux besoins : atteindre un niveau minimum d'égalité entre les candidats, et assurer la participation de tous aux élections sans que leurs capacités financières limitées soient un obstacle à cela, d'une part, et d'autre part, mener des élections saines et correctes dans une atmosphère de transparence, Le résultat conséquent du sentiment citoyen que son vote n'est ni vendu ni acheté, mais plutôt un vote qui est donné à ceux qui le méritent indépendamment de ce que le candidat a dépensé. Abstract The issues of financing the election compains have a significant impact on the quality of elections, So the legislator intervened by Ordinance No. 21-01 containing the organic law relating to the electoral system to control and monitor the process of financing othe electoral campaigns by submitting the candidates ' electoral campaign accounts to the supervision of the Election Campaign Finance Supervisory Commission of the Independent National Electoral Authority Created for the first time under this law, in order to find a balance between two needs: to achieve at least an equality between the candidates, and ensuring the participation of all in the elections without their limited financial capacities being an obstacle to this, on the one hand, and on the other hand, conducting a fair and correct elections in an atmosphere of transparency, and it’s consequentce of the citizen's feeling that his vote is neither sold nor bought, otherwise a vote that is given to those who deserve it regardless of what the candidate has spent.
