الإطلاع على الوثائق الإدارية في ظل الحماية القانونية

الملخص
يتناول هذا المقال موضوع الوثائق الإدارية وإمكانيات الإطلاع عليها، حيث أنها تتكون نتيجة لمختلف أنشطة المؤسسة التي تمارس من خلال الجهاز الإداري والتنظيمي، ويمكن لهذه الوثائق أن تحمل في طياتها معلومات هامة وحساسة لتلك المؤسسة والتي تعبر عن هويتها وتساهم في تحقيق أهدافها. ولأن المؤسسة تحتفظ بكم هائل من المعلومات والوثائق الإدارية، يجب أن تسير بمنهجية، لأنها تدخل في تكوين الرصيد الأرشيفي للمؤسسة، ومسألة الإطلاع عليها وتبليغها هو حق لطالبيها، من جانب أخر قد يمنع من الوصول إليها بسبب سرية بعض الوثائق، ولهذا كان لا بد من الاعتماد على النص التشريعي ليضبط فترات وطرق الوصول والإطلاع عليها. This article deals with the administrative documents and the possibilities of their communication; they are formed as a result of different activities of the institution that are practiced through the administrative and organizational system. And those documents can contain important and sensitive information for that institution and which express its identity, and contribute to achieve its goals. And because the institution maintains a huge amount of information and administrative documents, they must be managed systematically because they are evolved in the composition of the archival collection of the institution, and the question of their communication is the right of their applicants. On the other hand, access to them may be prevented due to the confidentiality of some documents. Therefore, the legislative text should be relied on to adjust their periods, access and their communication.
