ازدواجية عملياتية عسكرية في ليبيا في إطار السلام الدولي

الملخص
يلاحظ في تعامل مجلس الأمن مع القضايا المشابهة لحالة ليبيا أن هناك معيارين، الأول، يتعلق بطبيعة الاستراتيجية ذاتها. والثاني، يتعلق بتفويضه جزء من ولايته العالمية على التدخل الإنساني لحلف الناتو. حيث مزج هذا الأخير بين نمطين من التدخل، أحدهما عسكري تقليدي والآخر مدني حديث. أهدف من خلال هذه الدراسة، إلى إبراز مدى نجاح الناتو في الاختبار الذي خضع له، والذي يتمثل في موازنته بين اعتبارات السلم والأمن الدولي وبين مستلزمات قوات حفظ السلام، حيث خلصت في الأخير إلى نتيجة مفادها أن، مشروعية تصرفه بناءا على ذلك، ذي معيارية مزدوجة، منها ما يتصل بطبيعة النزاع مباشرة، ومنها ما هو مقيد بنظرية التفويض. It is noted in the SC’s dealing with issues similar to the case of Libya, that there are two criteria: the first, related to the nature of the strategy itself. The second, relates to this delegating part of his global mandate to the principle of NATO humanitarian intervention. The latter mixed two types of intervention, one traditional military and the other civilian modern. I aim, through this study, to highlight the extent to which the latter succeeded in the test he was subjected to, which is to balance international peace and security considerations with the requirements of peacekeeping forces. In the end, I came to the conclusion that: the legality of the act accordingly has a double standard, some of which are directly related to the nature of the conflict, and some of them are restricted by the delegation theory.
