الملخص
يعتبر موضوع المصنفات الرقمية أحد قضايا الساعة، نظرًا لما يشهده العالم من ثورة معلوماتية وتطور تكنولوجي سريع، حيث أصبحت هذه المصنفات ذات قيمة فكرية مرتبطة بالعصرنة ذات العلاقة بحقوق المؤلف، لكن خلفت بدورها انعكاسات على طرق النشر و التأليف مما نتج عنها من انتشار ظاهرة القرصنة والاعتداء على الانفتاح المعرفي رغم مساعي المجتمع الدولي في مجال الحماية ،لكن كان هناك قصور في التشريعات القانونية الوطنية ،لعدم مواكبتها للتطورات الرقمية لهذا السبب ظهرت حتمية اتخاذ تدابير تقنية ذات طابع إلكتروني تساهم في فرض الرقابة والحد من الخروقات لغرض تشجيع الابتكار والمساهمة في التنمية الثقافية والاجتماعية والاقتصادية.The issue of digital Works Is one of the curent issues, Gien the information révolution and Rapids technological développement That the world Is witnessing, as thèse Works have become of intellectual value linked to modernization related to copyright, but in turn had repercussions on the methods of publishing and authorship, which resulted in the spread of the phenomenon of piracy and abuse, on the openness of knowledge dispute the efforts of the international Community in the Field of protection,, but there was a short coming in the national legal legislation, because it did not keep pace with digital development for this reason, the inevitability appeared to take technical measures of an electronic nature that contribute to imposing control and limiting violations for the purpose of encouraging innovation and contributing to cultural, social and economic development.
