الملخص
The present study is a comparative analysis of the various advantages of arbitration methods of settlement often chosen by the parties involved in disputes relating to investiments. These arbitration regulations are ‘ICSID’ and ‘UNCTRAL’. Thus, the most important issues raised by the theme will be dealt with in the first part of this article , through the study of characteristics common to both types of arbitration rules sharing two main points : the new principles applicable in international arbitration and the guarantee of fundamental rules of arbitral procedure. In the second part, we will be focusing on the specificities of these two madels of settlement, first, in terms of the framing of the arbitral process, then, in terms of the effectiveness of the sentence.
