عقد المزارعة في التشريع الفلسطيني

الملخص
يعتبر عقد المزارعة من العقود المسماة، وهو نوع من عقود الإيجار التي تندرج تحت عقود المنفعة، وقد نص عليها المشرع الفلسطيني في الباب الثاني من الكتاب الثاني من القانون المدني الفلسطيني رقم (4) لسنة 2012م، وعليه تهدف هذه الدراسة إلى تبيان عقد المزارعة في التشريع الفلسطيني من حيث مفهومه وأركانه والالتزامات الواقعة على أطرافه. وقد توصل الباحثان في هذه الدراسة إلى العديد من النتائج كان أبرزها أنه لا ينتهي عقد المزارعة بموت صاحب الأرض، لكن ينتهي بموت المزارع، وفي هذه الأخيرة يجوز لورثة المزارع أن يحلوا محل مورثهم حتى ينضج الزرع. The Agricultural contract is one of the specific contracts, and it is a type of lease contract that falls under the benefit contracts. It was stipulated by the Palestinian legislator in the second chapter of the second book of the Palestinian Civil Law No. (4) of 2012 AD, and accordingly this study aims to clarify the Agricultural contract in the legislation of The Palestinian in terms of its concept, its pillars, and the obligations of its parties. The most important conclusion made by the researchers in this study was that the Agricultural contract does not terminate at the landowner's death but rather upon the farmer's death. In this case, the farmer's heirs may subrogate their deceased until the plantation matures. Keywords: agricultural contract; Farming; the crop; Palestine.
