التوقيع الالكتروني في ظل الظروف الاستثنائية Electronic Signature Under Exceptional Circumstances

الملخص
لا ريب أنّ الاعتماد على مسألة التوقيع الإلكتروني في إثبات المعاملات الالكترونية في ظل الظروف الاستثنائية سيكون بمعدلات معتبرة منه في ظل الظروف العادية كونها الملاذ الآمن والأمثل في مثل هذه الظروف للاستمرار بالنظر لتأُثير الظرف الاستثنائي في الحالات العادية على الالتزامات العقدية، وهو ما سمح ببروز استثناءات عن الأصل دون أن تكون سببا لفسخ أو تعديل العقود من خلال معالجة أثار التي تخلفها الظروف الاستثنائية. وبغية إثبات ذلك وتوثيقه كان لزاما الشروع في اعتماد لما يسمى التوقيع الإلكتروني كون أنّه أصبح غير مجدي الاعتماد على التوقيع التقليدي، والمسألة لم تكن خاصة بمجال على حساب آخر بقدر ما عم على جميع المعاملات الضخمة منها والبسيطة.
