أثر القواعد الفقهية الكبرى في أحكام النوازل الطبية

الملخص
ملخص: تتناول هذه الدراسة القواعد الفقهية الكبرى وأقسامها، وأثرها في أحكام النوازل الطبية، والطب والشرع قرينان لا يفترقان، حاجة كلّ منهما للآخر، كحاجة الإنسان للماء والهواء، ومن بين أنحاء الاجتهاد في مجال النوازل الطبية الجانب الخاص بالقواعد الفقهية الكبرى التي لها أثر تكليفي منوط بالنوازل الطبية، يتجلى في بيان الحكم الشرعي لما استجدّ من مسائل طبية لم تكن في الزمن السابق، وسببه أن الحوادث والوقائع متكررة لا متناهية، بخلاف النصوص فهي ثابتة ومحدودة، ؛ فاحتاج المجتهد إلى استنباط أحكامها من خلال أدلة الشريعة وقواعدها، ومن بين هذه الأدلة القواعد الفقهية الكبرى؛ فتمخض البحث عن عدة نتائج أهمها: تعريف القواعد الفقهية الكبرى وأقسامها، وأثر القواعد الفقهية الكبرى في أحكاما النوازل الطبية. Abstract: This study deals with the major juristic rules and their sections, and their effect on the provisions of medical developments. Medicine and Sharia are two unrelated spouses, each need for the other, such as the human need for water and air. It is evident in the statement of the legal ruling regarding the new medical issues that were not in the previous time, and the reason for this is that accidents and incidents are infinite and repeated, unlike the texts, they are fixed and limited; The mujtahid needed to derive its rulings through the evidence of Sharia and its rules, and among these evidence the major juristic rules; The search resulted in several results, the most important of which are: the definition of the major juristic rules and their sections, and the effect of the major juristic rules on the provisions of medical developments.
