تأثير مخاطر التطور العلمي على قواعد المسؤولية المدنية

الملخص
إن التطور العلمي في مجال الاستهلاك سلاح ذو حدين فمن جهة قد ساهم في وفرة المنتوجات بتطور تقنيات الإنتاج، ومن جهة أخرى ظهور مخاطر التقدم العلمي التي لا يمكن للمنتج ولا حتى المستوى المعرفي والتقني أن يتنبأ بها، مما حتم ﺫلك على معظم التشريعات المقارنة كالتشريع الأوروبي والفرنسي أن يعفي المنتج من مسؤوليته المدنية بسبب هذا النوع من المخاطر ،أمّا بالنّسبة للمشرع الجزائري فلم يأخذ بالإعفاء و نص على مسؤولية المنتج عند تعديله للقانون المدني - المادة140مكرر- كما أنه مؤخرا قد ألزم المنتج بمطابقة أمن المنتوج للمستوى الحالي للمعارف والتكنولوجيا بحثا عن حماية فعالة للمستهلك من كل المخاطر التي تهدد أمنه وسلامته. The scientific development in the field of consumption is a double-edged weapon, on the one hand, has contributed to the abundance of products by the development of production techniques, and on the other hand the emergence of risks of scientific progress that the product, not even the cognitive and technical level can predict, which necessitated most comparative legislation, such as European and French legislation, to exempt the product from its civil liability because of this type of risk, but for the Algerian legislator did not take the product's responsibility when amending the civil law - Article 140bre- and recently it has not taken the product's responsibility and exemption. The product is obliged to match product security to the current level of knowledge and technology in search of effective protection for the consumer from all threats to its security and safety.
