الملخص
في هذه الدّراسة؛ حدّدت معنى تركه صلى الله عليه وسلّم، ثمّ أكّدت ضرورة النظر في سياقاته ومقاماته عند إرادة التّشريع ، ثمّ شرعت بعدها في تفصيل المضمون باستقراء السياقات الظاّهرة في تروكه صلّى الله عليه وسلّم مبرزا لأهمّ هذه السياقات ، مفصّلا في بيانها، وممثّلا لها، ومستنتجا لمعانيها، وراصداً لأبعادها ومراميها، ثمّ مستنبطاً لأحكامها..، ثمّ ختمت الدّراسة ببيان القيمة الاسدلالية لترك النبي صلى الله عليه وسلّم، ومدى الحضور الحيويّ والظاّهر للسياق الذي جاء فيه. in this study, I define the meaning of the Prophet’s desisting, then I re-affirme looking back to the time and space context when extracting the laws. After that, I have attempted to detail the content by reading into the apparent contexts to his desisting, and stressing emphasis on the most important ones amongst those contexts with detailed explanation and illustrating examples, as well as extracting its meanings and spotting the purpose behind them while eliciting the laws.. In conclusion, I have presented the indicative value of the desisting of the prophet peace be upon him in addition to the vivid and apparent significance of the surrounding context.
