السلطة العليا للشفافية والوقاية من الفساد ومكافحته على ضوء القانون 08/22

الملخص
إن مكافحة ظاهرة الفساد التي تفشت في الجزائر بشكل رهيب في السنوات الأخيرة، جعلت الدولة تعمل على تقوية مؤسسات الرقابة ومن بينها السلطة العليا للشفافية والوقاية من الفساد ومكافحته، التي نص عليها المؤسس الدستوري لأول مرة في التعديل الدستوري لسنة 2016 ليغيّر تسميتها في التعديل الدستوري لسنة 2020 مع توسيع مهامها لتضطلع بدورها الرقابي الحقيقي في الوقاية من الفساد ومكافحته، وتخرج من دائرة الجمود الذي كانت عليه في السابق. والسلطة العليا للشفافية والوقاية من الفساد ومكافحته باعتبارها مؤسسة دستورية مستقلة تم تنظيمها وتحديد تشكيلتها وصلاحياتها بموجب القانون رقم 22/08. حيث تضمن هذا القانون قواعد تكفل استقلالية السلطة العليا للشفافية والوقاية من الفساد ومكافحته من خلال التشكيلة المتنوعة لأعضائها، كما وسع من صلاحياتها الرقابية، وأصبح بإمكانها إخطار السلطة القضائية بكل الأفعال ذات الوصف الجزائي. Abstract: The phenomenon of Struggle against corruption that tremendously spreads in Algeria for the last years, the state was obliged to strengthen control institutions such as the higher authority for transparency and prevention and struggle against corruption, which the constitutional legislator for the first time in constitutional amendment of 2016 to change its name for 2020 and to enlarge mission in terms of real control role in prevention and struggle against corruption and to get rid of previous stagnancy. The higher authority for transparency and prevention and struggle against corruption is an independent constitutional institution that was organized and determined in terms of composition and prerogatives in view of law no. 08/22, considering that, the asked law includes rules that take in charge the independency of the higher authority for transparency and prevention and struggle against corruption through various composition of members as well as control prerogatives are widen, so it possible to warn judicial authority of all action of penal description.
