الملخص

تعتبر مسألة خضوع الدولة للقانون ميزة من أهم مميزات الدولة الحديثة و مبدأ من المبادئ الدستورية التي تسعى كل الدول الى تطبيقها واحترامها و تكريس ما يكفي من الضمانات لتحقيق ذلك، و يعني هذا المبدأ بصفة عامة خضوع الحكام و كافة أجهزة ومؤسسات الدولة الممارسة للسلطة للقانون، و بمعنى اخر هو تقييد جميع قرارات و أعمال السلطات العامة بالقانون شأنها شأن الأفراد. فالدولة ليست لها حرية مطلقة في وضع القانون وتعديله بل هناك قيود و ضوابط وشروط محددة يجب التقيد بها، كما أن دولة القانون لا تتحقق إلا من خلال تحقق مجموعة من الأسس و المبادئ، و منه فان موضوع ورقتنا البحثية هذه يتمحور حول مفهوم سيادة القانون و دولة القانون و مدى تعزيز الإصلاحات الدستورية الأخيرة في الجزائر لمقوماتها و ركائزها. the issue of the state’s subordination to the law is one of the most important features of the modern state and one of the constitutional principles that all states strive to implement and respect. this principle generally means that rulers and all state agencies and institutions that exercise authority are subject to the law, that is, all decisions and actions of public authorities are bound by law in the same way as individuals. the state does not have absolute freedom to set and amend the law. rather, there are specific restrictions, controls and conditions that must be adhered to, and the state of law can only be achieved through a set of foundations. therefore, the topic of this research paper revolves around the concept of the rule of law and the rule of law, and the extent to which the recent constitutional reforms in algeria have strengthened their componentst.
